New DNCSolution Feature Scrubs Lists to Ensure CASL Compliance

Press ReleaseAtlanta, Ga. – August 10, 2016 –  PossibleNOW, the leading provider of customer engagement and enterprise preference management solutions, today announced a significant enhancement to DNCSolution®, its cloud-based do not contact application that helps marketers ensure compliance with current consumer privacy rules and regulations: a feature to confirm consent for Canadian consumers and businesses under Canada’s Anti-Spam Legislation (CASL).

“CASL-related litigation has disrupted many companies’ marketing activities to Canadian consumers and businesses,” said Ron Patrick, PossibleNOW’s Director of Product Architecture, “and created a lot of fear over those unable to verify appropriate consent on an ongoing basis. DNCSolution now includes a CASL-specific feature that allows companies to confirm consent and communicate with confidence to audiences across the Canadian border.”

One of the toughest laws of its kind in the world, CASL combines stringent consent requirements with a maximum monetary penalty of $10 million per violation for businesses and $1 million per violation for individuals. CASL became law in 2014 and provided a three-year transition period to allow companies to continue to market to their current database of electronic addresses (pre 2014). The transitional provision implies a person’s consent to receive Commercial Electronic Messages (CEM) until July 1, 2017, provided that the organization has an existing business or non-business relationship with their customers and the relationship has included the sending of at least one CEM.

On July 1, 2017, Canadian citizens will gain the right to allege violations and pursue private actions against offenders, a transition that is expected to increase CASL-related litigation significantly.

Along with the CASL scrub tool, the latest DNCSolution release offers enhancements to existing features including a more intuitive user interface for ease of use and navigation, and color-coded channels (call, email, mail, fax, text) for a clear visual indicator of which channel is in use.

DNCSolution v10 also introduces important new features including:

  • Ability to upload express consent data and store it in a DNC filter
  • Users that leverage DNCSolution in conjunction with MyPreferences, PossibleNOW’s enterprise preference management solution, can collect express written consent to call a consumer on a mobile device using an automated dialer
  • An optional service in which users can identify plaintiffs and attorneys who have previously been involved in multiple lawsuits, or who were identified as professional plaintiffs in individual or class action lawsuits
